Residence permit applications in Turkey can sometimes be made for certain exceptional cases. Article 22 of the YUKK (Law on Foreigners and International Protection) regulates these exceptional cases and the scope in which these applications can be made in detail. ARTICLE 22 – (1) Residence permit applications can be made exceptionally valid in the following cases:
a) In the decisions or requests of judicial or administrative authorities,
b) In cases where it is not reasonable for the foreigner to leave Turkey,
c) In long-term residence permits,
d) In student residence permits,
e) In humanitarian residence permits,
f) In residence permits for victims of human trafficking,
g) In transitions from family residence permit to short-term residence permit,
h) In applications to be made by the parent(s) with a residence permit in Turkey for their children born in Turkey,
i) In applications to be made to obtain a new residence permit appropriate to the new purpose of stay, due to the termination or change of the reason for which the valid residence permit was granted,
j) In transitions to short-term residence permits for those who have completed their higher education in Turkey.
These provisions cover situations where certain conditions are met for foreigners to obtain a residence permit in Turkey. For example, certain groups such as those under the influence of judicial or administrative decisions or victims of human trafficking can benefit from these exceptional applications.
Conditions for Obtaining a Short-Term Residence Permit Under Normal Circumstances in Turkey
Valid Passport or Travel Document: The applicant must have a valid passport or travel document.
Visa Status: The applicant must have the visa required for entry into Turkey. Visa exemption may apply for some countries.
Residence Appropriate to Purpose: The applicant must apply for a type of residence permit appropriate to the purpose of their stay in Turkey. Short-term residence permit is generally granted for temporary purposes such as touristic visits, commercial activities, family visits, etc.
Financial Status: The applicant must submit documents showing that they have financial resources to sustain themselves in Turkey.
Health Insurance: The applicant must have valid health insurance to benefit from health services during their residence in Turkey.
Criminal Record: The applicant must have a clean criminal record for entry into Turkey and the residence permit application. Any criminal record or legal proceedings may cause issues.
Application and Fees: The applicant must complete the required documents without omission and pay the application fee.
